Digital Image License Terms and Agreement
IMPORTANT INFORMATION - EFFECTIVE MAY 21, 2020
CLIENT/BUYER'S USAGE
The Client/Buyer shall only use the digital files/images, referred to as [Media] from this point forward, in accordance with the permissions within this agreement. The Client/Buyer’s digital files are for personal use only and shall not be submitted to contests, reproduced for commercial use, or reproduced in any way by parties other than the Photographer [BLUES Photography]. The redistribution of Media is strictly prohibited.
BLUES Photography grants Client/Buyer a non-exclusive, non-transferable, perpetual, personal-use license to reproduce Media via print only for any non-commercial use, including but not limited to reprints, enlargements, gifts to family and friends, slide shows, and social media accounts, and web pages. Title and ownership, and all rights now and in the future, of and for the Media remain exclusively with BLUEs Photography. There are no warranties, expressed or implied. The Media is provided to the Client/Buyer "as is."
SOCIAL MEDIA
The Client/Buyer may share blog post links or Instagram and/or Facebook albums, or Media on all web accounts that are considered under the social media umbrella, through use of the share functions and dissemination of direct links. All Media posted on social media require a direct link or credit towards BLUES Photography. Client/Buyer shall not copy, download, screen shot, or capture the photographs in any other fashion. Client/Buyer also shall not crop, edit, or add filters to any photographs. This includes Facebook’s “automatic” filter. If you do so, you may be subject to a $250 fine per photo.
PRIVELEGES AND PROHIBITIONS
The Client/Buyer is free to use Media for personal, non-commercial purposes. This includes display on personal websites, social media accounts and computers and downloading Media for personal use.
The Client/Buyer is prohibited to resell, re-license, sub-license, and/or redistribute Media without express written permission from the Photographer [BLUES Photographer]; use the Media in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration; use the Media in advertising; use the Media in a pornographic, obscene, illegal, immoral, libelous, or defamatory manner; incorporate the Media into trademarks, logos, or service marks; or make the Media available for download.
Neither BLUES Photography nor BLUES Photography's vendors will be liable for any third party claims or incidental, consequential or other damages arising out of this license or Buyer's use of the Media.
LICENSE
All images are property of BLUES Photography and are copyrighted by law. None can be copied, used, or published for commercial purposes without BLUES Photography's clear permission to do so. BLUES Photography reserves the right to use all of Client/Buyer's images on website, blogs, or any other related marketing material.
